2. USERS

The access and / or use of this GOSMART portal attributes the condition of USER, who accepts, from such access and / or use, the General Conditions of Use reflected here. The aforementioned conditions shall apply regardless of the General Conditions of Contract that may be binding.

3. USE OF THIS WEBSITE

The website provides access to a multitude of information, services, programs or data (hereinafter "the contents") on the Internet belonging to GOSMART to which the user can have access. The USER assumes responsibility for the use of the portal. This responsibility extends to the registration necessary to access certain services or contents. In this registration, the USER will be responsible for providing true and lawful information. As a consequence of this registration, the USER can be provided with a password for which he or she will be responsible, committing to make diligent and confidential use of it. The USER undertakes to make appropriate use of the contents and services (such as chat services, discussion forums or newsgroups) that GOSMART offers through its portal and as an example but not limited to, not use them for: 1) commit illicit or illegal activities contrary to the good faith and public order. 2) Disseminate content or propaganda of a racist, xenophobic, pornographic-illegal, terrorist or human rights nature. 3) To cause damage to the physical and logical systems of GOSMART, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage. 4) Attempt to access and, where appropriate, use the e-mail accounts of other users and modify or manipulate their messages. GOSMART reserves the right to withdraw all comments and contributions that violate the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that violate youth or childhood, public order or security or that, in its opinion, were not suitable for publication. In any case, GOSMART will not be responsible for the opinions expressed by users through forums, chats or other participation tools.

4. PERSONAL DATA PROTECTION

GOSMART complies with the directives of the Spanish Personal Data Protection Act 15/1999, of 13 December, and of Royal Decree 1720/2007, of 21 December, approving the Regulations enacting the Act and other legislation in force at any given moment, and ensures correct use and treatment of the personal data of the user. GOSMART is the owner or delegated holder of all the intellectual and industrial property rights of its website, as well as the elements contained in it, including but not limited to: images, sound, audio, video, software or texts, trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, among others. All rights reserved. By virtue of the provisions of Articles 8 and 32.1, second paragraph, of the Law on Intellectual Property, it is expressly prohibited the reproduction, distribution and public communication, including its mode of making available, of all or part of the contents of this website, for commercial purposes, in any medium and by any means, without the authorization of GOSMART. In order to make use of the services offered by GOSMART, minors must obtain prior authorization from the parent, guardian or legal representative, who will be held responsible for all acts carried out by the minors under their care. 12. APPLICABLE LEGISLATION AND JURISDICTION

The relationship between GOSMART and the USER will be governed by current Spanish legislation and any controversy will be submitted to the Courts and Tribunals of the city of MADRID.
